These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and HeartLink Technologies Pvt. Ltd. ("HeartLink," "we," "us," or "our") governing your use of the HeartLink mobile application and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

2.1 Age Requirements

• You must be at least 18 years old to use HeartLink
• By using the Service, you represent and warrant that you meet the minimum age requirement
• We reserve the right to request proof of age and may terminate accounts that violate this requirement

2.2 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You may not create multiple accounts or use someone else's account
• You may not impersonate any person or entity

2.3 Prohibited Users

You may not use the Service if you:

• Are a convicted sex offender
• Have been previously banned from HeartLink
• Are prohibited by law from using our services

3. User Conduct & Community Guidelines

3.1 Acceptable Use

You agree to use the Service respectfully and lawfully. You may:

• ✅ Connect with other users through our matching system
• ✅ Send messages to matched users
• ✅ Report inappropriate behavior

3.2 Prohibited Conduct

You agree NOT to:

• ❌ Hate Speech: Post content promoting violence, discrimination, or hatred
• ❌ Adult Content: Share sexually explicit or pornographic content
• ❌ Spam: Send unsolicited commercial messages or spam
• ❌ Fraud: Engage in fraudulent activities or scams
• ❌ Impersonation: Pretend to be someone else or create fake profiles
• ❌ Minors: Solicit information from or exploit minors
• ❌ Violence: Promote or threaten violence
• ❌ Illegal Activity: Engage in any illegal conduct
• ❌ System Abuse: Attempt to hack, reverse-engineer, or disrupt the Service
• ❌ Bots/Scripts: Use automated systems to access the Service
• ❌ Data Scraping: Scrape, copy, or harvest user data

4. Content

4.1 Your Content

• You retain ownership of content you post (photos, bio, messages)
• By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for Service operation
• You are solely responsible for your content and its legality
• You must have all necessary rights to the content you post

4.2 Content Moderation

• We reserve the right to review, monitor, and remove content that violates these Terms
• We use automated tools and manual review for content moderation
• We may remove content without prior notice
• Removed content does not guarantee account termination (depends on severity)

4.3 User-Generated Content

Other users' content does not represent our views. We are not responsible for:

• Accuracy, reliability, or legality of user content
• Offensive, inappropriate, or harmful content posted by users
• Interactions and relationships formed through the Service

5. Privacy & Data Protection

• Our collection and use of personal information is governed by our Privacy Policy
• You consent to data collection as described in the Privacy Policy
• You control your privacy settings within the app
• You can request data deletion at any time via Data Deletion

6. Premium Features & Payments

6.1 Subscription Plans

HeartLink may offer premium subscription plans with additional features:

• Unlimited likes and super likes
• See who liked you
• Rewind last swipe
• Boost profile visibility
• Advanced filters and preferences

6.2 Billing & Payments

• Subscription fees are billed in advance on a recurring basis (monthly/yearly)
• Payments are processed through third-party payment processors
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for applicable fees

6.3 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods or unused features

6.4 Price Changes

• We may change subscription pricing with 30 days' notice
• Price changes apply to new subscriptions and renewals after notice period

7. Intellectual Property

7.1 Our Intellectual Property

• The Service, including software, design, trademarks, and content, is owned by HeartLink
• You may not copy, modify, distribute, or reverse-engineer the Service
• HeartLink® and the HeartLink logo are registered trademarks

7.2 Copyright Infringement

If you believe your copyright has been infringed, contact us at:

8. Disclaimers & Limitations of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING:

• No guarantee of finding matches or relationships
• No warranty of uninterrupted or error-free service
• No guarantee of accuracy, reliability, or quality of content
• No warranty regarding security or data protection (though we use reasonable measures)

8.2 User Responsibility

• You are solely responsible for your interactions with other users
• We do not conduct background checks on users
• We are not responsible for users' conduct, online or offline
• Exercise caution and common sense when meeting people online

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months (or $100 if you haven't paid anything)
• We are not liable for damages arising from: user conduct, content, unauthorized access, service interruptions, or third-party actions

9. Indemnification

You agree to indemnify, defend, and hold harmless HeartLink, its affiliates, and employees from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your content or conduct on the Service
• Your interactions with other users
• Your violation of any third-party rights

10. Termination

10.1 Termination by You

• You may delete your account at any time via app settings
• Subscription fees are non-refundable upon termination

10.2 Termination by Us

We may suspend or terminate your account at any time for:

• Violation of these Terms or Community Guidelines
• Fraudulent or illegal activity
• Behavior that harms other users or our reputation
• Extended inactivity (after notice)

10.3 Effect of Termination

• Your right to access the Service immediately ceases
• Your content may be deleted (subject to legal retention requirements)
• Provisions that should survive (liability limitations, indemnification) remain in effect

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

11.2 Jurisdiction

Exclusive jurisdiction for disputes lies with courts in Mumbai, Maharashtra, India.

11.3 Arbitration (Optional)

For disputes under ₹10 lakhs, parties may agree to binding arbitration under the Arbitration and Conciliation Act, 1996.

11.4 No Class Actions

You agree to resolve disputes individually, not as part of a class or representative action.

12. Changes to Terms

• We may modify these Terms at any time
• Material changes will be notified via email or in-app notification
• Continued use after changes constitutes acceptance
• If you don't agree to changes, you must stop using the Service

13. Miscellaneous

13.1 Entire Agreement

These Terms, Privacy Policy, and Community Guidelines constitute the entire agreement between you and HeartLink.

13.2 Severability

If any provision is found invalid, the remaining provisions remain in full effect.

13.3 No Waiver

Failure to enforce any right or provision does not constitute a waiver.

13.4 Assignment

You may not assign these Terms. We may assign our rights without restriction.

13.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, etc.).
